1. Overview and Definitions

Welcome to Paws at You! “We,” “us,” and “our” refer to Paws at You, operated by Gyula Magera, individual entrepreneur (e.v.). “You” and “your” refer to customers and visitors. We provide this store and website—including all related content, features, tools, products, and services (the “Services”)—via the Shopify platform.
By accessing or using our Services, you agree to these Terms of Service (“Terms”) and all referenced policies (e.g., Privacy Policy, Return and Refund Policy, Shipping Policy). If you do not agree, please do not use the Services.
Definitions:

  1. Account: Your session authenticated by a one-time email code.

  2. Order: Your offer to purchase products by completing checkout and paying the displayed price.

  3. Withdrawal: Your right to cancel an Order within 14 days under Section 7.

  4. Content: Any text, images, graphics, video, audio, or other materials on the Services.

2. Access and Account

  1. No registration is required. You authenticate via a one-time login code sent to your email by Shopify.

  2. You affirm that you are of legal age in your jurisdiction and authorize any dependents to use Services on devices you control.

  3. You are solely responsible for safeguarding your login credentials and all activity under your Account.

3. Products and Descriptions

  1. We strive for accurate product representations; however, device settings and screen configurations may affect appearance.

  2. Descriptions, prices, and availability may change without notice.

  3. We reserve the right to discontinue any product or limit quantities at any time.

4. Orders

  1. By placing an Order (completing checkout and payment), you make an offer to purchase.

  2. We may accept or decline Orders at our sole discretion. An Order is accepted only upon sending a confirmation email.

  3. Payment must be received and processed before acceptance.

  4. If we cannot fulfill or modify your Order, we will attempt to notify you using the contact details you provided.

5. Prices and Payment

  1. Prices at checkout include VAT and exclude shipping, handling, customs, and import fees.

  2. Shipping costs are calculated and displayed before purchase.

  3. Prices, discounts, and promotions may change without notice; the price at Order placement applies.

  4. Promotional terms govern promotional pricing; in case of conflict, promotional terms prevail.

  5. You agree to provide accurate payment information and authorize us (and our payment processors) to charge your chosen payment method for all applicable amounts.

7. Right of Withdrawal and Returns

8. Warranty and Liability

  1. Statutory Warranty: Consumers are entitled to a 2-year warranty under Hungarian law (Act V of 2013). During the first year, we bear the burden of proof for any defect. After that, the burden shifts to you to prove the defect existed at delivery. Defects must be reported within 2 months of discovery.

  2. Mandatory Manufacturer’s Warranty: Applies only to products with a sales price of at least HUF 10,000:

    • HUF 10,000–250,000: 2 years

    • Above HUF 250,000: 3 years

  3. Vis Maior: We are not liable for failure to perform due to events beyond our control (e.g., natural disasters, strikes, governmental actions).

  4. Limitation of Liability: Our liability for direct damages is limited to the purchase price. We exclude liability for indirect, incidental, special, or consequential damages.

9. Intellectual Property

All Content on the Services—including trademarks, text, images, graphics, video, and audio—is owned by Paws at You, its affiliates, or licensors. You may use the Services for personal, non-commercial purposes only. No reproduction, distribution, modification, or public display without prior written consent.

10. Third-Party Tools and Links

We may provide access to third-party tools and links (“Optional Tools”). We do not control these and provide them “as is” and “as available.” Your use is at your own risk, and you should review the third party’s terms.

11. Relationship with Shopify

Paws at You is powered by Shopify. Any sales are directly between you and Paws at You; Shopify is not responsible for transactions, product quality, or delivery. You release Shopify from all related claims.

12. Privacy Policy

13. Feedback

By submitting feedback, ideas, or suggestions (“Feedback”), you grant Paws at You a perpetual, worldwide, royalty-free license to use, reproduce, modify, and distribute such Feedback. You represent you have all rights to submit Feedback and that it does not infringe third-party rights.

14. Errors, Inaccuracies, and Omissions

We strive for accuracy, but the Services may contain typographical errors, inaccuracies, or omissions. We reserve the right to correct, update, or remove content and to cancel Orders if information is inaccurate, at any time without notice.

15. Prohibited Uses

You may use the Services only for lawful purposes. Prohibited activities include:

  • Violating any law or regulation

  • Infringing intellectual property rights

  • Uploading malicious code or harmful content

  • Impersonating others

  • Spamming or scraping

  • Circumventing security measures

16. Termination

We may suspend or terminate your access at any time without notice if you breach these Terms. Sections 9, 11, and 13–15, and 17–24 survive termination.

17. Disclaimer of Warranties

THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT ANY WARRANTY, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

18. Indemnification

You agree to indemnify, defend, and hold harmless Paws at You, Shopify, and their affiliates from any claims, damages, liabilities, costs, or expenses arising from your breach of these Terms or your use of the Services.

19. Severability

If any provision of these Terms is found invalid, unlawful, or unenforceable, the remaining provisions remain in full force and effect.

20. Waiver; Entire Agreement

Failure to enforce any right is not a waiver. These Terms, together with referenced policies, constitute the entire agreement between you and Paws at You.

21. Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign these Terms at any time without consent.

22. Headings

Headings are for convenience only and do not affect interpretation.

23. Governing Law and Dispute Resolution

These Terms are governed by Hungarian law. Disputes shall be attempted to be resolved amicably, then before the consumer conciliation board, the National Consumer Protection Authority, or the Hungarian courts.

24. Amendments

We may update these Terms by posting revisions on our website and updating the effective date. Continued use after changes constitutes acceptance.
